Sentencias absolutorias y condenatorias por la jurisdicción ordinaria ante la justicia especial para la paz

Abstract

Teniendo como punto de inicio la entrada en vigencia el Acto Legislativo 01 de 2017, por medio del cual se crea un título de disposiciones transitorias de la Constitución para la finalización del conflicto armado y la construcción de una paz estable y duradera donde se dictan otras disposiciones, este documento pretende hacer una revisión de las sentencias absolutorias y condenatorias por la justicia ordinaria ante la justicia especial para la paz de tal manera que se pueda verificar el derecho del debido proceso, así como de realizar un análisis del ejercicio de los derechos fundamentales y las posibles formas de vulneración de los mismos. Así las cosas, el punto de interés radica en los análisis de las sentencias C-522 y C.774 de la Corte Constitucional. Por lo anterior, el presente artículo busca responder la siguiente pregunta ¿Cómo garantizar el principio (Nom Bis In Idem) en el marco de la Justicia Especial para la Paz, el respeto al debido proceso y los derechos humanos?

Taking as a starting point the entry into force of Legislative Act 01 of 2017 by means of which a title of transitory provisions of the Constitution is created for the termination of the armed conflict and the construction of a stable and lasting peace and other provisions are issued, This document intends to review the acquittals and convictions by the ordinary justice before the special justice for peace in such a way that the right to due process can be verified, as well as to carry out an analysis of the exercise of fundamental rights and the possible ways of violating them. Thus, the point of interest lies in the analysis of judgments C-522 and C.774 of the Constitutional Court. Therefore, this article seeks to answer the following question: How to guarantee the principle (Nom Bis In Idem) within the framework of the Special Justice for Peace, respect for due process and human rights?
