Crímenes de guerra y lesa humanidad por terrorismo en contra de la población civil: análisis de la conducta transgresora entre 1995 y 2010.

Abstract

Este estudio investigó los atentados contra la población civil por insurgencias colombianas entre 1995 y 2010, enfocándose en la alineación de estos actos con las definiciones de crímenes de guerra y lesa humanidad según la jurisprudencia de la Corte Penal Internacional. Con 285,293 ataques documentados, de los cuales un 13% afectaron a campesinos residentes de áreas rurales no considerados objetivos militares legítimos, la investigación buscó establecer los elementos fáctico-jurídicos que tipificaron las acciones terroristas ocurridas entre 1995 y 2010 en contra del actor poblacional con conductas asociadas a crímenes de guerra y lesa humanidad. Lo anterior ameritó la realización de estudios cualitativos para exponer que los atentados terroristas en contra de la población civil sobre territorio colombiano entre las fechas señaladas sí fueron patrones sistemáticos y conductas predeterminadas, empleadas por las insurgencias para generar afectaciones de orden nacional, pero, sobre todo, regional y gubernamental.

This study investigated the attacks against the civilian population by Colombian insurgencies between 1995 and 2010, focusing on the alignment of these acts with the definitions of war crimes and crimes against humanity according to the jurisprudence of the International Criminal Court. With 285,293 documented attacks, of which 13% affected peasants and residents of rural areas not considered legitimate military targets, the research sought to establish the factual and legal elements that characterized the terrorist actions that occurred between 1995 and 2010 against the civilian population with conduct associated with war crimes and crimes against humanity. This required conducting qualitative studies to demonstrate that the terrorist attacks against the civilian population on Colombian territory during the specified dates were indeed systematic patterns and predetermined behaviors used by insurgencies to cause disruptions at the national level, but especially at the regional and governmental levels
